Fee Schedule

- PER DIEM FEES.

Having mediated thousands of matters throughout Southern California since 1993, Mr. Kruis has learned that it takes significant time and effort to facilitate the settlement of a contested dispute. In order to maximize the opportunity for resolution, he requests the parties to make an appropriate commitment to the mediation process by reserving a full day ($7,000 per diem). Matters generally start between 9:00 a.m. and 10:00 a.m. The amount charged includes two hours of reading and pre-mediation consultation, all travel time and expenses, and eight hours of conference time (surplus preparation time is added to conference time). Additionally, there is an administrative fee of $350 per party per day. Mr. Kruis charges for EXTRA TIME as provided in Paragraph 2.

- EXTRA TIME.
Mr. Kruis charges for extra preparation, conference and follow-up time at $700 per hour. After the mediation has concluded, we will send a supplemental invoice which is due and payable upon receipt.
- THIRD-PARTY FACILITIES COSTS.
ADR Services, Inc., has conference facilities which will comfortably accommodate mediations in San Diego, Orange County, Century City, Downtown Los Angeles, San Francisco, and Silicon Valley. If a mediation is requested in another venue and conference facilities must be rented, the cost will be charged to the mediation participants.
- FEE AND COST ALLOCATION.
PER DIEM FEES (Paragraph 1), EXTRA TIME (Paragraph 2) and THIRD-PARTY FACILITIES COSTS (Paragraph 3) will be billed to and are due from the mediation participants in equal, pro rata shares unless they agree to a different allocation and notify us at the time of billing.
- DEPOSITS.
Each participant's share of the total amount due must be deposited within ten days after issuance of invoices in order to guarantee the reservation, unless the date is sooner, in which case the deposit is due immediately. Otherwise, we may offer the date to other potential mediation participants.
- CANCELLATION AND POSTPONEMENT.
If the mediation is canceled or postponed within 15 days of the scheduled date, the party requesting the cancellation or postponement is responsible for the entire deposit (not just the canceling party’s share of the deposit), unless Mr. Kruis’ time can be rescheduled for another matter. If appropriate notice is given, we are happy to assist counsel with rescheduling a hearing. If appropriate notice is given, there is no continuance fee for the first rescheduling. For the second rescheduling and thereafter, if appropriate notice is provided, a $100 continuance fee is billed per change.
- PAYMENT RESPONSIBILITY.
The attorney and his or her client are jointly and severally liable to ADR Services, Inc., for payment of fees and costs. The contract to retain Mr. Kruis’s services is entered into at 225 Broadway, Suite 1400, San Diego, California.
