Fee Schedule

1. PER DIEM FEES.
   1. Per Day
      Kruis Mediation (KM) charges $3,660 per day (eight hours of conference time). Full day matters generally start at 9:30 a.m. The amount charged includes the case administrative fee, pre-mediation consultation, and one and one-half hours of reading time and the conference time (surplus reading time is added to conference time).
      
      The per diem is more for mediations scheduled outside of Downtown San Diego. KM charges for EXTRA TIME as provided in Paragraph 2.
      
      
   2. Per Half-day
      KM charges $1,980 per half-day in two-party matters (three and one-half hours of conference time). Half-day matters generally start at 9:00 a.m. or 1:30 p.m. The amount charged includes the case administrative fee, pre-mediation consultation, one hour of reading time and the conference time (surplus reading time is added to conference time).
      
      The per diem is more for mediations scheduled outside of Downtown San Diego. Half days are not available outside of San Diego County, nor in matters with three or more parties (see paragraph 1c, below) because those matters require more time to settle. KM charges for EXTRA TIME as provided in Paragraph 2.
      
      
   3. Per Three-Quarter-day
      KM charges $2,760 per three-quarter-day (five and one-half hours of conference time). Three-quarter day matters generally start at 9:30 a.m. The amount charged includes the case administrative fee, pre-mediation consultation, one hour of reading time, and the conference time (surplus reading time is added to conference time).
      
      The per diem is more for mediations scheduled outside of Downtown San Diego. Three-quarter-days are not available outside of San Diego County, nor in matters with four or more parties. Rather, a full day must be reserved (eight hours of conference time). KM charges for EXTRA TIME as provided in Paragraph 2.
   
   
2. EXTRA TIME.
   KM charges for Mr. Kruis's extra preparation, conference and follow-up time at $395 per hour. After the mediation has concluded, KM will send a supplemental invoice which is due and payable upon receipt.
   
   
3. CONSTRUCTION DEFECT MEDIATION.
   Due to administrative and logistical complexity, KM assesses a twenty percent (20%) surcharge on PER DIEM FEES (Paragraph 1) and EXTRA TIME (Paragraph 2) in complex, multi-party construction defect matters.
   
   
4. THIRD-PARTY FACILITIES COSTS.
   In San Diego, KM has conference facilities which will comfortably accommodate up to twelve (12) mediation participants. Outside San Diego, KM may need to rent conference facilities at a cost to the mediation participants ranging between $100 and $300 per day.
   
   
5. FEE AND COST ALLOCATION.
   PER DIEM FEES (Paragraph 1), EXTRA TIME (Paragraph 2) and THIRD-PARTY FACILITIES COSTS (Paragraph 3) will be billed to and are due from the mediation participants in equal, pro rata shares unless they agree to a different allocation and notify KM at least fourteen (14) days before the mediation.
   
   
6. CANCELLATION AND POSTPONEMENT.
   If the mediation is canceled or postponed within 21 days of the scheduled date, the party requesting the cancellation or postponement is responsible for the entire deposit (not just the canceling party's share of the deposit), unless Mr. Kruis's time can be rescheduled for another matter.
   
   
7. DEPOSIT, CANCELLATION, AND POSTPONEMENT POLICY.
   In order to reserve a confirmed mediation date, KM must receive the deposit within 21 days before the mediation session, or the date may be offered to other potential mediation participants. When a mediation is canceled or postponed within 21 days of its scheduled date, KM makes every effort to schedule another matter. If one cannot be scheduled, the party canceling or postponing the mediation, instead of the other party or mediator, should bear the economic burden. Therefore, the party responsible for taking the mediation off-calendar is sent a supplemental invoice for the other party's share of the deposit. There is no charge if the mediation is taken off-calendar at least 21 days before the reserved date.
   
   
8. PAYMENT RESPONSIBILITY.
   The attorney and his or her client are jointly and severally liable to Kruis Mediation (Taxpayer I.D. No, 33-0909060) for payment of fees and costs. The contract to retain Mr. Kruis's services is entered into at 501 West Broadway, Suite 1330, San Diego, California.
   
   
9. EFFECTIVE DATE.
